This Privacy Policy describes how Mizuno USA, Inc. and Mizuno Canada Ltd. (collectively, “Mizuno,” “we,” “us,” or “our” as appropriate) collect, use, disclose, and protect your personal information.  We are committed to commercially reasonable measures aimed at safeguarding the privacy of individuals who visit our websites (the “Sites”) and those who use our various services, including our mobile applications, or any other services that link to this Privacy Policy. This includes purchases of our products in our stores, online or through third-party partners, in-store visits, interactions with us, engagement on social media, or participation in any of our programs or events (collectively referred to as the “Services”). This Privacy Policy applies to Mizuno’s customer-facing activities in the United States and Canada. Our Sites may contain links to websites and/or applications that are operated and maintained by third parties. This Privacy Policy does not apply to how third parties process your personal information. We recommend that you review the privacy practices of those third parties.    
 
The definition of “personal information” may be different under individual state or province regulations.  As used in this Privacy Policy, “personal information” refers to information that identifies, relates to, describes, or can be associated with you.  
 
This Privacy Policy is not intended to apply to personal information we collect about our employees, applicants for employment, or contractors in the employment context.

1. WHAT PERSONAL INFORMATION WE COLLECT  
 
We collect personal information about you when you interact with us and our products and services. The table below identifies the categories of personal information we collect and provide examples of personal information in such categories, along with information on the third parties with whom such categories of information are shared:  

 

 

If you visit our Sites to browse, we will only intentionally collect and store the domain name and host from which a user accessed the Internet, the IP address of the user’s computer, the user’s browser software and operating system, the date and time the user accesses the Sites and the Internet address of any website from which the user linked directly to our Sites or to which the user links after visiting our Sites. We use this information to measure the number of visitors to sections of our Sites, to determine from where our visitors linked and to where our visitors link from the Sites or to help us make our Sites more useful. For example, we organize and analyze IP addresses so that we can provide efficient service, enhance security, monitor appropriate usage and produce traffic volume statistics. This type of information is sometimes shared with third parties, such as when we aggregate and disclose site traffic information for marketing and commercial purposes, with your consent where required by law.   
 
If you register, send us a communication or engage in a transaction while at our Sites, we may collect or store certain user information, including your user ID and password (if applicable) and we may also collect personal information you provide through this process (We encourage you NOT to include personal information in your user ID or password).  If you engage in a transaction while logged on to our Sites, then we may collect or store information about the transaction, including products or services purchased, payment information, and account information. If you send us communications, then we may collect or store such communications in a file specific to you. 
 
2. HOW WE COLLECT PERSONAL INFORMATION 
 
We collect personal information about you from various sources. For example, we collect and obtain information:  
 
Directly from you.  We collect personal information you provide, such as when you make a purchase; register for an account or create a profile; sign up for the Mizuno MVP membership; make an appointment for in-store services; interact with us in store; participate in a sweepstakes, contest, or other similar campaign or promotion; respond to a survey; write product reviews; or sign up to receive emails, and/or text messages. 
 
Using online tracking technologies and other automatic data collection technologies.  When you visit our Sites, use our applications, open or click on emails we send you, or interact with our advertisements, we or third parties we work with automatically collect certain information using online tracking technologies such as pixel tags, beacons, and cookies. This information includes IP address, browser software and operating system, date and time, and the Internet address of any website from which the user linked directly to our Sites or to which the user links after visiting our Sites. 
 
Through other offline technologies.  We record customer service calls and maintain transcript of chats for quality assurance.  
 
Via in-store and other offline technologies.  We employ Closed Circuit Television (CCTV) in our stores for safety, security, fraud prevention, loss prevention, and operational needs.  
 
From Social Media Platforms and Networks.  If you communicate or interact with us on social media sites, we collect information that you disclose to us, or that the social media platforms disclose to us. For more information about the privacy practices of those social media platforms, please review the privacy practices and settings of the social media platforms and networks that you use.  
 
3. HOW WE USE PERSONAL INFORMATION 
 
We use the information we collect from you for the following purposes:  
 
Providing you with the Services.  We use personal information to verify your identity; to set up and maintain your accounts; to process payments and fulfill your orders; and to provide you with the Services you request from us. We also use personal information to build features that we hope will make our Services more attractive and easier for you to use, provide better customer support or provide timely notice of new services, with your consent where required by law.  
 
Communicating with you.  We use personal information to communicate with you, such as to respond to any questions, comments or requests you have about the Services, and to provide customer support.  
 
Marketing and promotional purposes.  We use personal information for marketing and promotional purposes, such as to send marketing, advertising, and promotional communications by email, or text message; to show you advertisements for new products and/or new services; and to administer our sweepstakes, contests, and other similar promotions, with your consent where required by law. 
 
Administering Mizuno Programs.  With your consent where required by law, we use personal information to administer our programs, such as the Mizuno MVP Loyalty Rewards Program, and the Mizuno Movement Program. This may include setting up and verifying your account, communicating with you regarding the program, evaluating your application, and tracking the rewards or points you earn for purchasing product.  
 
Analytics, research and service improvement.  With you consent where required by law, we use personal information to conduct research and analytics, including the Services and product offering; to understand how you interact with the Sites, our mobile applications, advertisements, and communications with you; to determine which of our products are the most popular; to improve the Sites, our mobile applications, and marketing campaigns. In certain instances, research data may be de-identified, compiled, and analyzed collectively. We may then share this aggregated data with our affiliates, agents, service providers, and other business partners. This may include, usage, performance, and product data. This aggregated information does not contain personally identifiable information.  
 
Security and fraud prevention.  We use personal information to detect and counteract any misuse or detrimental actions, including fraud, spam, and illegal activities that impact our Services. This involves the use of personal identifiers, user profiles, data usage, and various data types to detect instances of fraud, authentication issues, or other harmful activities.  
 
Legal obligations.  We may need to disclose personal information in response to legal processes initiating in civil proceedings or by law enforcement or other government officials if appropriate under the law, and there is nothing in this Privacy Policy that should be construed as a limitation on our ability to respond to valid legal process.  
 
4. HOW WE SHARE PERSONAL INFORMATION 
 
We may share your personal information to the following categories of recipients:  
 
Group Companies.  We may share your personal information with our group companies, including Mizuno USA, Inc. and Mizuno Canada Ltd. for the purposes of assisting us in providing our Services to you.  
 
Service Providers.  We may share certain personal information with our service providers who process personal information for purposes described in this Privacy Policy. In particular: 
    1.   We share payment information with payment processors so they can help us facilitate payments; 
    2.   We use cloud storage providers to protect and store personal information; 
    3.   We share basic identifying information with delivery companies to help facilitate the delivery of our products to you; and 
    4.   We share basic identifying information, geolocation data, device information and other unique identifiers with advertising and marketing partners for the purposes of deploying, managing and improving our marketing strategies, including through the placement of retargeted ads. 
 
We may also share aggregated or de-identified information with service providers for analytics. This information is not linked to personal information that can identify you. We ensure that data is not shared with any third-party service providers unless there is a valid data protection agreement or contractual language in effect.  
 
Legal Process.  We may disclose your personal information in response to subpoenas, warrants, court orders, government inquiries, or investigations or to comply with relevant laws and regulations. Additionally, we may also disclose personal information to exercise, establish, or safeguard the rights our company, employees, agents, and affiliates; to counter legal claims; to identify and prevent fraud; and to address potential illegal activities.  
 
Potential Buyers. We may disclose personal information with another company that buys some, or all, of the assets or stock of Mizuno, and the company may use and disclose personal information for purposes similar to what is described in this Privacy Policy.  
 
5. WHAT PERSONAL INFORMATION WE SHARE 
 
State laws, such as those in California, require that we list the categories of personal information that we have disclosed to third parties for business purposes in the last 12 months.  In the past 12 months, we have disclosed all of the categories of personal information we describe in Section 1. WHAT PERSONAL INFORMATION WE COLLECT for business purposes.  
 
The California Privacy Rights Act (CPRA) defines the terms “sale” broadly, and it may include selling/sharing certain information for particular purposes through technology such as cookies or other identifiers.  We never sell personal information to third parties for money nor do we “share” it for targeted advertising purposes (as defined by state privacy law). However, under the CPRA, when you visit our Sites, we and our partners may collect certain information about you, your devices, and your behavior through cookies, pixel tags or other identifiers that may be considered a “sale/share” even if no money is exchanged.  
 
We do not use or disclose sensitive personal information, as defined in the applicable privacy laws, about you except as necessary to provide you with our Services, including processing and fulfilling orders and verifying your information, to prevent fraudulent or illegal actions, and for other purposes that do not infer characteristics about you.  
 
6. HOW WE PROTECT YOUR PERSONAL INFORMATION 
 
We endeavor to protect personal information with physical, technical and administrative safeguards appropriate to the sensitivity of the personal information. However, perfect security does not exist, and we cannot guarantee the absolute security of your personal information.  
 
When your personal information is no longer required for the purposes set out in this policy, we delete it or anonymize it according to our retention guidelines (subject to record-keeping and other legal or business requirements).  
 
 
7. YOUR RIGHTS  
 
You may withdraw consent to the continued use or disclosure of your personal information at any time, subject to certain restrictions provided by law.  
 
If you do not want to provide us with certain personal information then you should opt out by not using the Services that provide us with such personal information. For example, if you do not want us to retain your name, then you may choose not to become a registered user or not to send us a communication. You will not be entitled to the benefits of registration or a response to the communication, but you are still free to browse the Sites. 
 
If you longer wish to receive our notices or promotional materials, you may opt out of receiving these communications by replying to unsubscribe in the subject line in the email or email us as referenced below. You may also choose to unsubscribe from notices of special offers at any time. We provide you with the ability to unsubscribe at any time via the consumer account space noted on the confirmation of your order. If you no longer wish to receive our SMS messages related to product availability at nearby retailers, as well as general marketing information, reply to a SMS message with the word "STOP". To re-subscribe, reply with the word "START". 
 
Law in your state or province may allow you to have certain rights, subject to certain restrictions, such as:  
 
Right to data portability/access.  You may be entitled to obtain access to your personal information or receive the specific personal information we have collected in the 12 months preceding your request. 
 
Right to deletion.  You may be entitled to request that we delete the personal information that we have collected from you.  We will use commercially reasonable efforts to honor your request, in compliance with applicable laws.  Please note, however, that we may need to keep such information, such as for our legitimate business purposes or as required to comply with applicable law.   
 
Opt-out/Limiting use.  Visitors of our Sites can opt out of being tracked by clicking on the Manage Website Data Collection Preferences link below. You may also be able to opt out of some collection or uses of your personal information. You may opt out by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC) on the browsers and/or browser extensions that support a signal.  To download and use a browser supporting the GPC browser signal, visit https://globalprivacycontrol.org/.  If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.  
 
Rectification.  You have the right to correct inaccurate information.  
 
If you would like to exercise one of your rights, please submit your request to privacy@mizunousa.com. 
 
For us to process some requests, we will need to verify your identify to confirm that the request came from you.  We may contact you by phone or email to verify your request.  Depending on your request, we will ask for information such as your name, an email address that you have used, or a phone number you have used with Mizuno.  For certain requests, we may also ask you to provide details about the most recent purchase you made online or in store.  
 
You may also designate an authorized agent to submit a request on your behalf to access or delete your personal information.  To do so, you must: (1) provide the authorized agent written and signed permission to submit such request; and (2) verify your own identity directly with us.  Please note, we may deny a request from an authorized agent that does not submit proof that they have been authorized by you to act on your behalf.   
 
California’s “Shine the Light” law, permits users of our Sites that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes.  To make such a request, please send an email to privacy@mizunosau.com. 
 
8. COOKIES AND SIMILAR ONLINE TRACKING TECHNOLOGIES 
 
Cookies are small text files that our Sites can send to your browser for storage on your hard drive. Cookies can make your use of our Sites easier by saving your status and preferences upon visits to our Sites. By default, the cookies are resent to your browser every time you enter the Sites. Most browsers are initially set to accept cookies, but you may be able to change the settings to refuse cookies or to be alerted when cookies are being sent. We intentionally use cookies for the following purposes: (1) to enable Mizuno to customize information for certain segments of its customer base; (2) in some instances, to associate you with your personal information; (3) for site analytics purposes to understand how visitors interact with the Sites and improve the Sites; and (4) for retargeted advertising through our third-party partners. For example, through the use of cookies you may login automatically and thereby save you time. Although rejection of cookies will not interfere with your ability to interact with most of our Sites, it may cause your user experience to be more cumbersome.  
You can opt out of cookies we use on the Sites by updating your preferences in the Website Data Collection Preferences.  
If you do not wish for cookies to be placed on your device, most web browsers permit you to prevent that from taking place. 9. INTERNATIONAL DATA TRANSFERS 


Mizuno Canada Ltd. is located in Canada and uses service providers that may be located in the United States. If you submit personal information to Mizuno Canada Ltd., your personal information may be processed in the United States. Similarly, if you are located in Quebec, your personal information may be transferred outside of Quebec, subject to risk assessments required by law. Accordingly, your personal information may be accessible to courts, law enforcement and national security entities outside of Canada. By submitting your personal information to us you agree to the transfer, storage, and processing of your personal information in the United States.  
 
10. COMMUNICATIONS FROM US  
 
Responses to communications.  We endeavor to send responses to all reasonable communications from users. Established members will occasionally receive information on products, services or special deals. Out of respect for the privacy of our users we present the option to not receive these types of communications. Please see Section 7. YOUR RIGHTS to opt out of receiving these communications 
 
Site and service updates.  We also send the user site and service announcement updates. We communicate with the user to provide requested services via email or phone. 
 
Correction and updating personal information.  If a user’s personal information changes (such as zip code), or if a user no longer desires our Services, we will endeavor to provide a way to correct, update or remove that user’s personal data provided to us. This can usually be done by contacting us using the details provided under Section 13. HOW TO CONTACT US.  
 
11. CHILDREN’S PRIVACY 
 
Mizuno joins the industry in recognizing that children may not be able to make informed choices about personal information requested. Accordingly, Mizuno does not target children who do not meet the minimum age requirement applicable in your jurisdiction for collection of information or knowingly solicit or collect customer identifiable information from children under the minimum age. 
 
If we become aware that a child under the minimum age has provided us with personal information, we will delete the information from our records.  
 
12. MERGER, ASSETS, SALES, ETC. 
 
If Mizuno or any of its lines of business is sold, pledged or disposed of as a going concern whether by merger, sale of assets, bankruptcy or otherwise, then the user database of Mizuno could be sold as part of that transaction and all personal information accessed by such successor or purchaser. Similarly, personal information may be disclosed as part of the evaluation stage of a potential transaction, in accordance with applicable privacy laws.

For future reference, Mizuno will make a link to the current Privacy Policy available to you on your screen when you are on our Sites. Your use of the Sites constitutes your consent to have your personal information handled in accordance with this Privacy Policy and your assent to any modification thereto.
